Welcome to www.cmst.xyz. These Terms of Service contain the terms and conditions that govern all use of our Platform and Services and all content, services, and/or products available through the Platform (collectively, the “CMST Services”).

The CMST Services are offered to you subject to your acceptance of these Terms, including our Privacy Policy at www.cmst.xyz/privacy-policy. These Terms form a legally binding contract between Susankya Tech Pvt. Ltd. (“CMST”, “we”, “us” or “our”) and you, either individually or on behalf of your entity (“you” or “your”).

PLEASE READ THESE TERMS CAREFULLY. BY REGISTERING FOR, ACCESSING, OR USING THE CMST SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.

  1. Definitions

    “Account” means your account on the Platform;
    “Customer” refers to the legal person with an Account;
    “Platform” means the CMST application;
    “Services” includes all website features, products, and content.

  2. Our Service

    1. The CMST platform is a cloud-based work management tool for organizing data.
    2. We reserve the right to change these Terms and will notify you of substantial changes.
    3. You represent that:
      1. you are at least 18 years old,
      2. you represent a valid legal entity eligible to use the services.
      You may not access CMST Services for production or competitive monitoring without consent.

  3. Fees, Payment and Subscription

    1. Fees: CMST Services may be subject to fees based on the selected subscription plan. Fees are non-refundable.
    2. Free Plan: Offers limited access to the Platform.
    3. Billing: You authorize recurring charges unless you are in Nepal, where manual renewal may be necessary.

  4. Customer Data

    1. You retain rights to your Customer Data. You authorize CMST to process it, and you are solely responsible for it.
    2. Storage: Data is stored securely using AWS services with encryption.

  5. Privacy and Security

    1. Privacy: Please review our Privacy Policy. Contact us at support@cmst.xyz.
    2. Analytics: Aggregated data is collected for service improvement.
    3. Security: We use industry-standard measures to protect data.

  6. Intellectual Property Rights

    All content on CMST is protected by intellectual property laws. You may not copy or use CMST Materials without permission.

  7. Termination

    1. CMST may terminate accounts for breaches or non-payment.
    2. Upon termination, your access ends and data is deleted after 60 days. It's your responsibility to export it.
    3. We may suspend accounts at our discretion.

  8. Warranty Disclaimer

    CMST Services are provided "as-is" without any warranties.

  9. Limitation of Liability

    CMST shall not be liable for any kind of damages exceeding NPR 10,000. This includes direct or indirect losses, technical issues, and personal injuries.

  10. Indemnity

    You agree to indemnify and hold harmless CMST from claims or liabilities arising from your use of the CMST Services.

  11. Applicable Laws

    These Terms shall be governed by Nepalese law, with jurisdiction in Kathmandu, Nepal.

  12. No Waiver

    Failure to enforce any part of these Terms does not constitute a waiver.
